FREQUENTLY ASKED QUESTIONS
Who decides what the speed limits are and where?
The police liaise with local communities and County
councils before speed limits are introduced and it is the police
who enforce the limits set.
I think a speed camera 'took' my details - what happens
next?
If it did then the police will issue you a NIP (Notice
of Intended Prosecution) and it should arrive within 14 days (up
to 17 days to allow for postage).
What if I don't hear anything within the allotted
time?
If it was your car you were driving then you cannot
be prosecuted. However, if it was a hire car, a company car or
somebody else's vehicle then the police are allowed more time.
What is likely to happen if I was just over the limit?
You will receive the NIP as described above and the
offer of accepting a £60 fine and 3 penalty points. Most people
accept this but it may take you to 12 points which can and in most
cases does, mean a disqualification for a period of time.
What if my speed was considerably over the limit?
If your speed was considered excessive (usually 30
mph above the limit but can depend on circumstances) then you will
not be offered a fixed penalty but will receive a court summons.

What will it cost me to contact you?
Initially nothing. You can either call or fill in the
form. Based on the information provided, we will recommend
a course of action - or not. A case study will attract fees of £750
+vat. For this, we will review the information/papers provided and
provide a written advice letter to the client. If appropriate we
will also draft
a
mitigation letter to the relevant court
What information/papers would you require?
In addition to any papers relating to the case eg copy
of NIP, summons and any letters received, we will need your driving
license, both parts if you have the new style. We also need an up-to-date
utility bill showing your home address. Also, if you have made
any personal notes about the incident/situation they would be useful
too.
What
if I don't believe I was speeding or if convicted it will take me
to 12 points or more?
You should write and request evidence of the
alleged offence which by law they are required to produce - or
contact us!
Do many people 'fight' speeding tickets?
Figures suggest that less than 1% of people contest
their speeding tickets. If everybody fought them the courts would
probably grind to a halt!
Are speed camera detectors legal?
Presently all speed camera detectors are legal
in the UK but it will become illegal to own and use a radar or
laser detector (probably late 2007).
GPS based speed camera locators
will
remain
legal to own and use in this country.
